Chartered Surveyors are the only valuers officially authorised to carry out formal valuations of Spanish property for submission to British Courts, especially for Matrimonial disputes.
The Valuation requires the inspection of the property and a full written report to the appropriate Court for its consideration, the Chartered Surveyor acting in the role of an expert witness
The basis of the Valuation is normally an assessment by the Valuer of the Open Market Value of the property
as at the date of the inspection. The Open Market Value is defined as the price at which the property could reasonably expected to sell for,
as between a willing purchaser and a willing seller, after a normal period of marketing. The Open Market Value does not therefore represent the asking price for any property. In the valuer's opinion,
it is the likely sale figure of the property which could actually be obtained as at the date of valuation,
taking all relevant circumstances into account. To support the valuation the Chartered Surveyor will also supply appropriate evidence of comparable property
in the area of the property to be valued.
For matrimonial disputes the Chartered Surveyor is normally instructed jointly by the solicitors
acting for the individual parties and the fee for the valuation is therefore divided equally between
the parties. Two copies of the valuation report are submitted, one to each firm of solicitors in
time for the appropriate Court Hearing.
As an expert witness the Chartered Surveyor, when carrying out such Valuations, must remain independent
and act professionally at all times in accordance with his duty to the Court. The Judge may ask
the Chartered Surveyor to attend the hearing to explain or give further evidence with regard to the Valuation
